This website is operated by 13 Seconds Pte Ltd. Throughout the site, the terms “We”, “us”, “our” and “Seconds” refer to 13 Seconds Pte Ltd. Seconds offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site, usage of our app and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store and/or app shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

I. Definitions of Terms

1.1 “We”, “our” and “us” and “Seconds” refer to 13 Seconds Pte. Ltd.

1.2 “You” and “your” refer to the party or parties accessing and/or using the Website, Phone Application and/or Products.

1.3 “Affiliates” means, with reference to any business entity, any other entity that directly or indirectly Controls, is Controlled by, or is under common Control with it.

II. Service

2.1 We will use reasonable means to provide the Service. You agree that the Service provided may from time to time be unavailable in full or in part. We shall not be liable in any way whatsoever for its failure or inability to provide the Service.

2.2 You agree that we cannot and does not control or verify any Product Information and Content published on our Website. You fully assume the risk in relying on the Product Information and Content herein.

2.3 You agree that you will assume all risks for any transaction you enter into with us.

2.4 We are not responsible or liable for any Content posted by any User.

2.5 We are not obligated to provide the Service to you during times of maintenance.

2.6 We retain the absolute right to make changes to the terms of Service without notice.

III. Use of Products and Service

3.1 The Services are designed to be used in connection with Products containing our technology (e.g. Seconds Smart Switch), which you may purchase from us or one of our partners.

3.2 Subject to these Terms, Seconds grants you a non-transferable, non-exclusive, right (without the right to sublicense) to access and use the Services by (i) using the Sites in connection with, and solely for the purpose of, controlling and monitoring the Products installed on your property, or that you have been validly authorized to access, or to otherwise access a service explicitly provided by the Products for your use, and (ii) installing and using the Mobile App solely on your own handheld mobile device (e.g., smartphone, tablet, watch) and solely for the purposes set forth in (i) above. You agree to comply with all instructions, usage rules and documentation that we may provide from time to time with respect to the Service.

3.3 You acknowledge that the licensed software can only be used for non-commercial purpose and installation, application and running of the licensed software is prohibited. If such commercial operation is necessary, prior written authorization and permission from Seconds shall be obtained.

3.4 Seconds and its suppliers may change, upgrade or transfer the licensed software or relevant functions from time to time, and may add new functions or services in the licensed software system. If no separate agreements are accompanied with the aforesaid new functions or services, you are entitled to the corresponding functions and services, which is also subject to the Terms of Service.

3.5 You shall be responsible for the accuracy, reliability, integrity and legality of input data and legality of the way in which you obtain the data, and shall back up data and information from time to time. You shall bear all risks for damage and loss of such information.

3.6 You shall properly keep your account number and password. In case of any safety loophole for your account (including but not limited to divulgence of user password), you shall notify Seconds in time, and Seconds will assist you in taking relevant measures. Otherwise, all behaviors related to your account shall be assumed by you and you will bear all responsibilities. 

IV. Third Party Websites, Products and Services

4.1 The Services may be used in connection with other products and services, and may contain links and interfaces to, as well as content and data from, third-party websites, products and services. Any links and interfaces are provided solely as a convenience to you. By accessing or using these Other Services, you are consenting to the creation of an interface with such Other Services and agreeing that Second may exchange information and control data with such Other Services regarding you, your guests, your Products and use of the Services, including your and your guests’ personal information, in order to enable the Other Service interface and functionality, and its use by such Other Services. Once this information is shared with the Other Services, its use will be governed by the third party’s privacy policy and not by our Privacy Policy. Moreover, use of such Other Services is governed by separate terms and conditions provided by the providers of the applicable product or service.

4.2 You should review the terms of use and privacy policies of such Other Services before using them. We do not exercise control over such Other Services. We do not endorse the materials contained on Other Services and are not responsible for the performance of the Other Services. You acknowledge and agree that Seconds makes no representation or warranty about the safety of any Other Services. Accordingly, seconds is not responsible for your use of any Other Service or any personal injury, death, property damage (including, without limitation, to your home), or other harm or losses arising from or relating to your use of any Other Services. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party

V. User’s Content and User Conduct

5.1 You agree to use the Sites and the Services only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Sites or Services.

5.2 You agree not to do any of the following:

5.2.1 Post, upload, publish, submit or transmit any Content via our Service that: (i) infringes, misappropriates or violates a third party’s intellectual property rights, or rights of publicity or privacy; (ii) violates or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; or (v) promotes illegal or harmful activities or substances.

5.2.2 Use, display, mirror or frame the Services, or any individual elements within the Services, Seconds name, or any Seconds/13 Seconds/Seconds Smart App trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Second’s express written consent.

5.2.3 Use the Service in any manner which, in our sole judgment, degrades the user experience, reliability, speed, or operation of the Services, or any underlying hardware or software thereof;

5.2.4 Access, tamper with, or use non-public areas of the Services, Seconds computer systems, Sites, or the technical delivery system of Seconds’s providers.

5.2.5 Attempt to probe, scan, or test the vulnerability of any Product, Service, Site, software, system or network or breach any security or authentication measures, or to reverse engineer, decompile or otherwise attempt to gain the source code for any Seconds Service, Firmware or Product;

5.2.6 Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Seconds or any of second’s providers or any other third party (including another user) to protect the Service, Firmware or any Product;

5.2.7 Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Service;

5.2.8 Collect or store any personally identifiable information from the Service from other users of the Service without their express permission;

5.2.9 Use the Service to impersonate any person or send altered, deceptive or false source-identifying information, or misrepresent your affiliation with any person or entity;

5.2.10 Violate any applicable law or regulation; or

5.2.11 Encourage or enable any other individual to do any of the foregoing.

5.3 Although we’re not obligated to monitor access to or use of the Service or to review or edit any Content, we have the right to do so for the purpose of operating the Service, to ensure compliance with these Terms, or to comply with applicable law or other legal requirements. We reserve the right, but are not obligated, to remove or disable access the Service or any Content therein, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Content to be objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or conduct that affects the Service. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

VI. Privacy Policy and Data

The Privacy Policy available on Seconds Website explains how your personal data is collected, used and processed by us.

VII. Disclaimers

7.1 The Content is provided for general information purposes only. It is not intended to be comprehensive. We may, at any time, add, modify or remove any Content from the Website without notice. Although we use all reasonable endeavours to confirm the accuracy of any Content published on the Website, we shall not be responsible for inaccuracies, errors or omission in Content, or for any delay in transmission or delivery of such Content, or any loss or damage arising from the use of the Content or for any actions you take in reliance on the Content. You agree to make your own enquiries to verify the information provided and to assess the suitability of Products prior to any purchase made.

7.2 We may at any time impose limits or restrictions on the use you may make of the Website. Further, for security, technical, maintenance, legal, regulatory or other reasons, or due to any breach of these Terms of Use, we may withdraw the Website, or change or remove website functionality at any time without notice to you.

7.3 We make no warranty that the Website and/or the Content is free from infection by viruses or anything else which has contaminating or destructive properties and shall have no liability in respect thereof. You must take your own precautions to ensure that your use of the Website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system.

7.4 When you install, setup or use the Products and Services you are given the opportunity to change defaults or choose particular settings. The choices you make can cause non-recommended or unintended operation or non-operation of your Products and Services and any connected equipment or systems. You assume all liability for any damages and losses caused by, or related to, the choices you make for the particular settings for the Products and Services, and setting or changing defaults.

7.5 You understand and agree that the use of the Products and Services may not avert, eliminate or minimise such occurrences of events, such as fires, floods, burglaries, robberies, and medical issues, or their consequences, and, therefore, Seconds makes no express or implied warranty or representation (including any implied warranty of merchantability or fitness for particular purpose) that those products and services will so avert or minimise such occurrences of such events, or their consequences.

7.6 Seconds cares about the integrity and security of your personal information. We endeavour to implement appropriate security measures. However, Seconds cannot guarantee that unauthorised third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.

7.7 When you invite guests or service providers to use your Product or Services, you assume all responsibility for their use, and any damages that they may cause to you, Seconds, or any third party.

VIII. Limitations

8.1 Our aim is to make the Services highly reliable and available; however, they may not be available all of the time. The Services are subject to sporadic interruptions and failures for a variety of reasons beyond Second’s control, including without limitation, your Wi-Fi and mobile network failures and coverage limitations, service provider uptime, and acts of god. Further, our Services rely on or interoperate with a number of third-party products and services. These third-party products and services are beyond Seconds’s control, but their operation may impact or be impacted by the use and reliability of our Services. These third-party products and services may not operate in a reliable manner all of the time, and they may impact the way that the Services operate, and Seconds is not responsible for damages and losses due to the operation of these third-party products and services. You acknowledge these limitations and agree that Seconds is not responsible for any damages allegedly caused by the failure or delay of the Services. Further, the Products and Services are not an emergency notification system, and should not be used in this way. Seconds is not responsible for dispatching emergency authorities to your home in the event of an emergency.

8.2 You are responsible for all charges and fees required for your Products and applicable services, and for compliance with all applicable agreements, terms of use/service, and other policies of your product and service providers (including internet service providers and mobile device carriers).

8.3 To the fullest extent allowed by law, Seconds is not responsible for damage or liability caused by (i) use of the Products and Services for purposes other than for which the Products and Services are designed or intended, or use in improper temperature, humidity or other environmental conditions, or use of the Products or Services in violation of written instructions provided by Seconds (which may be provided at the time of purchase or on its website at seconds.cc), (ii) normal wear and tear or aging, or improper repair, operation or maintenance or connections to improper voltage supply or, to the extent allowed by law, attempted repair by anyone other than a facility authorized by Seconds to service your Product.

IX. Termination

These Terms remain in effect as long as you continue to use the Services. You can stop using our Services any time. We reserve the right to suspend or terminate your use of the Services or your access to the Sites at any time, with or without cause, and with or without notice. For example, we may suspend or terminate your use if you are not complying with these Terms, or use the Services in any way that would cause us legal liability or disrupt others’ use of the Services. We may also change or remove at any time any features currently offered as part of the Services, or the Services themselves. Upon termination, your Account and right to use the Services will automatically terminate. You agree that Seconds shall in no way be liable to you for any loss or damage that may result from discontinuance, cancellation or termination of Services or your account.

X. Wavier

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

XI. Indemnification

In no case shall Seconds, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

XII. Severability

In the event that any provision of these Service Agreement is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforce-ability of any other remaining provisions.

XIII. Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party

XIV. Changes to Terms of Service

You agree that Seconds may modify these Terms from time to time, and that your right to access the Services, is conditioned on an ongoing basis with your compliance with the then-current version of these Terms. By continuing to access the Site, Mobile App or use the Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Services.

XV. Governing Laws

These Terms shall be governed and construed in accordance with the laws of Singapore without regard to its conflict of law provisions. You agree that any dispute arising out of these Terms shall be resolved exclusively in the courts of the Republic of Singapore.

XVI. Vulnerability Disclosure Policy  

Security Support: We will provide security updates for SECONDS branded products to 31st December 2027.
